RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
免除责任和放弃赔偿权协议
PARTICIPANT: PLEASE READ CAREFULLY BEFORE SIGNING. THIS DOCUMENT HAS LEGAL CONSEQUENCES AND WILL AFFECT YOUR LEGAL RIGHTS AND ABILITY TO BRING FUTURE LEGAL ACTIONS.
参与者：请于签署前仔细阅读。本文书具有法律后果并将影响您在未来采取法律行动的法定权利与资格。
IN CONSIDERATION of being permitted to participate and/or perform in the event(s), contest(s) (each, a “Contest”) and other activities organized or managed by the Beijing International Ice Hockey or it’s volunteers including but not limited to it’s captains, commissioner(s), referees, scorekeepers or schedulers (“BIIH”) scheduled to take place at the ORG Arena in Crab Island, Beijing or any other venue related a Contest between September 2025 and May 2026 (collectively, the “Events”), the undersigned, on behalf of myself, my participant child or ward (if applicable) (the “Participant”), and Participant’s personal representatives, heirs, assigns, and next of kin, hereby:
基于被允许参加和/或在由北京国际冰球联盟（BIIH）或其志愿者，包括但不限于队长、联盟委员、裁判、记分员或赛程安排员，组织或管理的比赛（每项为“比赛”）及其他相关活动中进行表演，该等比赛和活动拟于2025年9月至2026年5月期间在北京蟹岛的奥众冰上运动中心或任何与比赛相关的其他场地举行（统称为“活动”），下方签署人，代表我本人、我的参赛子女或被监护人（如适用）（“参与者”），以及参与者的个人代表、继承人、受让人和近亲属，在此：
1. (a) 同意，在参与和/或表演前，参与者应检查将使用的设施和设备，并且，如果参与者认为某一物品是不安全的，参与者应立即将该等情况通知组织方正式工作人员并拒绝参与活动，直到该物品的状态得以修复；(b)确认并充分理解，参与者将参与存在可能造成严重伤害之固有风险和对参与者来说未知的或此次不能合理预知的其它风险的体育活动，该等严重伤害包括永久性的残疾和死亡，且该等永久性的残疾和死亡不仅可能是由于参与者的个人作为、不作为或疏忽引起的，也可能BIIH（包括其各自的行政人员、指定人员、被许可人、代理、教练、管理人员、董事、志愿者和员工）、其他参与者、操作员、供应商、赞助机构、赞助商、广告商、与活动有关而被使用的房屋的所有者和承租人（统称为“被免责方”）的作为、不作为或疏忽、项目的比赛规则、场所的条件或使用的任何设备的状态所引起的，且参与者理解并自愿承担参与活动的全部风险和责任；（c）声明并确认参与者处于良好的健康状况且不会由于参与者的健康原因而以任何方式被限制参加项目；（d）声明并确认参与者理解并遵守给予参与者的、与项目相关的所有比赛规则、指南、日程安排及指示，且对参与者违反这些比赛规则、指南、日程安排及指示的任何行为或疏忽的所有后果负全部责任；且（e）完全同意当被免责方认为有必要时被免责方被允许（而非有义务）为参与者提供医疗服务。
2. AGREES TO AND DOES HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE THE RELEASED ENTITIES FROM ALL LIABILITY AND CLAIMS FOR DAMAGES FOR DEATH, PERSONAL INJURY OR LOSS OR PROPERTY DAMAGE WHICH PARTICIPANT MAY HAVE OR WHICH MAY HEREAFTER ACCRUE TO PARTICIPANT, AS A RESULT OF PARTICIPANT’S PARTICIPATION IN OR OTHERWISE IN CONNECTION WITH THE EVENT, AND WHICH MAY BE ASSERTED BY PARTICIPANT OR ON PARTICIPANT’S BEHALF AGAINST ANY OF THE RELEASED ENTITIES, including but not limited to claims for injuries arising from the negligence of any Released Entity (including volunteer organizers);
2. 同意并在此免除、放弃和永久性地就可能由参与者或由他人代表参与者针对被免责方所提起的以下全部责任和赔偿主张给予被免责方以豁免：因参与者参加项目或以其它方式与活动有关而引起的、参与者可能遭受或此后可能发生在参与者身上的人身伤亡、财产毁损等损失所带来的全部责任和赔偿主张，包括但不限于因任何被免责方疏忽（包括志愿者组织者）引起的伤害；
3. AGREES TO HOLD HARMLESS, DEFEND, AND INDEMNIFY EACH OF THE RELEASED ENTITIES FROM ANY LOSS, LIABILITY, CLAIM, DAMAGE, JUDGMENT, LEGAL FEES, OR COSTS ARISING FROM OR INCURRED DUE TO PARTICIPANT’S PARTICIPATION IN OR OTHERWISE IN CONNECTION WITH THE EVENT, WHETHER CAUSED BY THE NEGLIGENCE OF ANY RELEASED ENTITY OR OTHERWISE;
3. 同意就以下事项使每一被免责方免受损害、为其辩护并对其进行赔偿：因参与者参加项目或以其它方式与项目有关而产生或遭受的任何损失、责任、主张、损害、判决、法律费用或成本，无论是否由于任何被免责方的疏忽或其它所引起；
4. agrees and warrants that Participant’s acts, poses, words and performances at the Event will be in good taste and will not reflect negatively on the image, reputation or business of the Released Entities, and grants full permission to each of the Released Entities (and each of their designees, agents and licensees), with no obligation to compensate Participant, for purposes of utilizing Participant’s name, voice, statements, image, likeness, biographical data and/or actions (the “Released Properties”)in any live or recorded audio, video, film, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the Event in any medium, whether now known or hereafter created, or context, without further authorization or compensation, and represents that Participant has the right to grant such permission;
4. 同意并保证，参与者在项目中的行为、姿态、语言和表演应表现出良好的品味、且不得有损被免责方的形象、声誉或业务；并充分许可每一被免责方（及其各自的指定人、代理和被许可人）（被免责方没有向参与者支付报酬的义务）在以任何媒介（无论是现在已知的还是后来开发的，包括但不限于社交媒体平台、网站和宣传材料）或情境为载体、由项目制作的或在活动现场制作的任何现场的或录制的音频、视频、影像、图片展示或其他传输、展览、出版物或复制品中使用参与者的姓名、声音、陈述、形象、肖像、人物信息和/或动作（“被免责的内容”），且无需进一步授权或支付报酬，并在此声明参与者有权授予该等许可；
5. agrees to relinquish, give, and assign to Released Entities all right, title, and interest that the Participant may have in the finished pictures, finished product, recordings, negatives, digital images, reproductions, copies of the original recordings, prints, derivative works, the Released Properties, advertising, or other copy that may be used in connection therewith relating to Participant’s participation in or otherwise in connection with the event, and further irrevocably and perpetually grant the Released Entities the right to give, sell, transfer, and exhibit such finished pictures, finished product, recordings, negatives, digital images, reproductions, copies of the original recordings, prints, negatives, derivative works, the Released Properties, advertising, or other copy that may be used in connection therewith to any responsible individual, business, firm, publication, or to any of their assignees and agrees to provide reasonable assistance to Released Entities needed to perfect or secure any of the Released Entities’ rights;
5. 同意放弃参与者对以下内容可能享有的全部权利、资格及利益、并向被免责方授予并转让给被免责方参与者对以下内容可能享有的全部权利、资格及利益：与参与者参加项目有关或以其它方式与项目有关的已完成的图片、已完成的产品、录音、底片、数码影像、复制品、原版录音的副本、印刷品、衍生作品、被免责的内容、广告及可能连同上述资料一起被使用的其它复制品，并进一步不可撤销地、永久性地授予被免责方将以下内容向任何负责个人、经营主体、公司、出版商、或前述所列各项的任何受让人进行赠予、出售、转让或展示的权利：该等已完成的图片、已完成的产品、录音、底片、数码影像、复制品、原版录音的副本、印刷品、底片及数码影像、衍生作品、经授权的内容、广告及可能连同上述资料一起被使用的其它复制品，并同意向被免责方提供为完善或保障被免责方任何权利所需的合理协助；
8. 参与者确认该联盟完全由志愿者运营，这些志愿者并非经过专业医疗、法律或场馆管理培训。参与者同意不因与活动有关的任何作为或不作为追究任何志愿者、组织者或联盟附属人员的责任。
9. 参与者了解其有责任确保自己所使用装备和服装的安全性和适用性，并免除BIIH及其志愿者因装备故障或误用而可能产生的任何责任。
7. expressly agrees that (a) this RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT is governed by the laws of People’s Republic of China (which for the purpose of this RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, does not include the laws of the Hong Kong Special Administrative Region, the Macau Special Administrative Region and Taiwan), and is intended to be as broad and inclusive as is permitted by the laws of People’s Republic of China, and that if any portion hereof is held invalid, it is agreed that the balance shall nonetheless continue in full legal force and effect; and (b) for the purposes of any action or proceeding arising out of or related to this RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, Participant and Released Entities agree to submit such action or proceeding for arbitration in and the jurisdiction of the China International Economic and Trade Arbitration Commission located in Beijing, China and agree that the language of any arbitration proceeding shall be English. The arbitration award will be final and binding on the parties to the arbitration.
7. 明确同意(a) 本权利放弃、责任豁免及赔偿协议受中华人民共和国法律管辖（为本协议目的，不包括香港特别行政区、澳门特别行政区和台湾地区的法律），并在中华人民共和国法律允许的范围内应作广义和宽泛解释，且如果任一部分被确定为无效，同意其它部分仍应继续具有完的法律效力；且(b)对因本权利放弃、责任豁免及赔偿协议引起或与其有关的任何行为或程序，参与者和被免责方同意将该等行为或程序提交位于中国北京的中国国际经济贸易仲裁委员会管辖并仲裁，且同意任何仲裁程序的语言为英语。仲裁裁决为终局的，对仲裁双方均有约束力。
PARTICIPANT HAS READ AND VOLUNTARILY SIGNS THIS RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, understands its terms, including that Participant is hereby giving up substantial legal rights, and further agrees that no oral representations, statements or inducement contrary to anything contained herein have been made by the Released Entities. If not signed by a parent or legal guardian below, Participant represents that Participant is eighteen (18) years of age or older, and Participant acknowledges that each of the Released Entities is relying on the grant of rights contained herein. If signed by a parent or legal guardian, the parent or legal guardian has explained the risk of participating in the activity and safety rules to the Participant and Participant understands the inherent risks and agrees to follow all rules of participating.
参与者已阅读并自愿签署本权利放弃、责任豁免及赔偿协议，理解其条款，包括参与者在此放弃实质性法律权利，且参与者进一步确认，被免责方没有做出与本权利放弃、责任豁免及赔偿协议的任何内容相悖的任何口头声明、陈述或者劝诱。如果下方签字人不是家长或法定监护人，则参与者声明，其已满十八（18）周岁，并确认每一被免责方依赖本权利放弃、责任豁免及赔偿协议中所授予的权利行事。如果下方签字人为家长或监护人，则家长或监护人已向参与者解释了参与活动的风险和安全规则，且参与者理解固有风险并同意遵守全部参与规则。
